1. Acceptance of Terms

By downloading, installing, or using Lactose Spy (the "App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the App. These Terms form a binding agreement between you and Comantis ("we", "us", or "our").

2. Description of Service

Lactose Spy lets you take or upload a photo of food and uses artificial intelligence to estimate the likelihood that the food contains lactose. The App is provided for general informational and educational purposes only.

3. Medical & Health Disclaimer

The App is not a medical device, diagnostic tool, or substitute for professional medical advice. Specifically:

• AI analysis results are probability estimates based on visual recognition and are inherently imperfect.
• The App may produce incorrect, incomplete, or misleading results for any given food item.
• Hidden or processed ingredients, cross-contamination, and manufacturing variations cannot be detected from a photo.
• Do not rely on the App to manage a medically diagnosed lactose intolerance, dairy allergy, or any other health condition.
• Always read food labels and consult a healthcare professional for dietary guidance.

4. AI Analysis Limitations

Our AI analysis is powered by third-party large language model services. You acknowledge that:

• Results are probabilistic, not definitive.
• The AI cannot inspect ingredient lists, nutritional information, or packaging not visible in the photo.
• Accuracy will vary significantly depending on photo quality, lighting, food presentation, and other factors.
• We make no warranty as to the accuracy or completeness of any analysis result.

5. User Content & Photos

When you use the App to analyse a photo, that image is transmitted to our AI provider's servers for processing. By submitting a photo, you represent that you have the right to share it. Please do not photograph people without their consent, or include images that contain sensitive personal information.

We do not retain your photos longer than necessary to process your request, and we do not use your photos to train AI models. Please see our Privacy Policy for full details.

6. In-App Purchases & Subscriptions

The App offers a free tier with a limited number of scans per month, and an optional paid subscription. All purchases are processed through Apple's App Store.

To maintain service quality and prevent abuse, all users are subject to usage limits. Free users receive a limited number of scans per calendar month. Paid subscribers may perform up to 100 scans per calendar day. These limits are subject to change at our discretion; current limits are enforced within the App. Exceeding or attempting to circumvent these limits may result in temporary restriction of access.

• Billing: Subscription fees are charged to your Apple ID at the time of purchase and automatically renew unless cancelled at least 24 hours before the end of the current period.
• Cancellation: You may cancel your subscription at any time in your Apple ID account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.
• Restore Purchases: If you have previously purchased a subscription, use the "Restore Purchases" option in the App to reinstate it on a new device.
• Refunds: All refund requests are handled by Apple. We have no ability to issue refunds directly.
• Price changes: We reserve the right to change subscription pricing with reasonable notice. Continued use after a price change constitutes acceptance.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or extract the source code of the App.
• Circumvent any scan limits or subscription features through technical means.
• Submit content that is harmful, offensive, or violates the rights of others.

8. Intellectual Property

All content, design, code, graphics, and trademarks in the App are the property of Comantis or its licensors. Nothing in these Terms grants you any right to use our trademarks, trade names, or branding.

9. Third-Party Services

The App uses third-party services including AI analysis providers and RevenueCat for subscription management. Your use of the App is subject to those services' own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or that results will be accurate or reliable.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Comantis shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including any harm resulting from reliance on AI analysis results. Our total liability to you for any claim shall not exceed the amount you paid for the App in the twelve months preceding the claim.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. App Store Terms

These Terms are between you and Comantis only, not Apple Inc. Apple is not responsible for the App or its content, and has no obligation to provide support or maintenance. In the event of any conflict between these Terms and Apple's App Store terms, Apple's terms shall take precedence to the extent of the conflict.
